Section 8
Sufficiency of name mentioned in notice

(1) If the following things are mentioned in the notice, the name of the mortgagee shall be deemed to be sufficiently disclosed in the notice:- (a) If the mortgagee is a natural person, the citizenship number mentioned in the certificate of Nepali citizenship received by him is mentioned in such notice, (b) The mortgagee is not- If the person is a Nepali citizen, the name mentioned in the passport received by him and the name and number of the country issuing that passport are mentioned in such notification, (c) If the mortgagee is an organized organization established in accordance with the prevailing law, the name and registration certificate number established and recognized in accordance with the prevailing law. If it is mentioned in the notice, (d) if the mortgagee is a foreign organization recognized to conduct business within the State of Nepal in accordance with the prevailing law, and (e) the name of the mortgagor is recognized in accordance with the prevailing law to conduct business within the State of Nepal, and (e) the mortgagee is If it is a foreign organized organization that is not registered under the company law but is allowed to conduct business within the state of Nepal according to the prevailing company law, the recognized name according to the prevailing law of the country where such organized organization is established is mentioned in such notification. Such notice shall not be considered ineffective just because the business name or any other name is not mentioned. However, if only the business name of the mortgagee is mentioned in the notice, the name of the mortgagee shall not be considered to be sufficiently mentioned in such notice. (3) Name of more than one mortgagee in the notice. And the name of more than one mortgagor can be mentioned. (4) The fact that a person is the representative of the mortgagor is not disclosed in the notification will not affect the adequacy of the notification.
